PREMISE

In this article, the user/client can review all the general contract conditions and, more specifically, the rules governing the relationships that take place:

• between Salento Prime Srl and the owners/holders of the properties;
• between Salento Prime Srl and the tenants-tourists;
• between the tenants-tourists and the respective owners/holders of the properties.

Salento Prime Srl It is a property management company operating on behalf of third parties with the aim of promoting tourism for the rental of properties that the principals (owners or holders) wish to offer to clients (tourists-tenants-guests).

Salento Prime Srl is therefore authorized by the principals to provide the following services:

• to advertise the real estate units on its own websites, on portals offering vacation rentals, and through any other communication channels deemed appropriate;
• to accept bookings for the real estate units on behalf and in the interest of the principals;
• to collect the deposit/balance on the agreed or established rental fee/price set by the Property Managers;
• in case of delegation/authorization from the principals, to carry out various operations related to the stay of the tenants-tourists, including: key delivery, collection of the balance and security deposit, key return, and handling of any disputes regarding damages caused by the tenants of the property.

The individual rental agreements occur exclusively between the Property Owner – Holder and the client (tourist-guest-tenant). Consequently, Salento Prime Srl remains entirely unrelated to this rental agreement.

The client (tourist-guest-tenant), by making a reservation through Salento Prime Srldeclares to be aware of the content of this informational document and to expressly and unequivocally accept the following general rental conditions:

General Rental Conditions

a) The reservation is considered confirmed once the deposit payment is received via bank transfer.

b) The client expressly excludes any other or different use of the property, except for purposes suitable to meet temporary housing needs and exclusively for tourism purposes.

c) The client must provide the Property Manager, at the beginning of the stay, with a list of all individuals, including their full personal details, who will occupy the property. This number may not, under any circumstances, exceed the number of beds stated in the property description, unless specifically agreed upon in advance with the Property Manager.

d) The tourist may cancel the reservation via certified email up to 30 days before the arrival date. In this case, they will forfeit the entire amount paid as a deposit. If the cancellation occurs within the 30 days prior to arrival, the client will be required to pay Salento Prime Srl the full amount agreed upon for the stay.

e) The rental agreements occur exclusively between the Property Owner – Holder and the client. Consequently, Salento Prime Srl remains unrelated to this agreement.

f) Upon arrival, the client must present valid identification documents for all group members and settle the remaining balance (if applicable), which can be paid in cash, by credit card, or by cashier’s check. Personal or postal checks will not be accepted.

g) Upon collecting the keys, the client becomes the custodian of the property, its furnishings, and all items listed in the inventory provided by the owner or their representative.

h) Ordinary and extraordinary maintenance will be handled by the owner or delegated companies. The client must not tamper with the systems and must contact Salento Prime Srl for any necessary assistance.

i) The owner or their representative reserves the right to access the property, in agreement with the client, for routine maintenance.

l) The client must pay a security deposit as a guarantee against any potential damages. If no damages occur, the amount will be refunded at the end of the stay.

m) The properties are delivered clean. Upon departure, the client must leave the property in an orderly condition. Failure to do so will result in deductions from the security deposit.

n) Utilities not included in the rental fee will be calculated and settled at the end of the stay.

o) In case the owner is unable to guarantee the rental, Salento Prime Srl commits to finding an equivalent accommodation or reimbursing the client.

p) For any dispute, the Court of Lecce shall have exclusive jurisdiction.

Intellectual Property

All photos and images on the website are protected by copyright. Unauthorized use is prohibited and legally enforceable.

However, refusal to provide the data will result in the inability to book an appointment and/or service on the Website.

Photographs and Videos

The Data Controller does not request the publication of photographs and/or videos featuring you. Therefore, your data will not be processed for these purposes.

Web scraping

The use of any automated process or system to access, acquire, copy, or monitor any part of our website, including but not limited to web scraping, crawling, or spidering techniques, is expressly prohibited. The Data Controller reserves the right to take all necessary measures, including legal actions, to prevent and pursue any unauthorized scraping activity. Art. 3 Retention of Personal Data

3.1 This article describes how long the Data Controller reserves the right to retain your personal data.

• Your personal data will be retained only for as long as necessary to ensure the proper provision of the services offered through the Website.
• For marketing purposes, personal data will be retained until consent is possibly withdrawn. For inactive users, personal data will be deleted one year after the sending of the last email that was possibly viewed.
• For the purpose of executing the sales contract, the data will be retained for 10 years from the date of receipt of the purchase order. This is to allow the Data Controller to exercise their right to defense and to demonstrate that the contract was properly executed.
• For customer care purposes, the data will be deleted once the assistance service is completed and, in any case, within a maximum period of 3 months from the last email exchange with the data subject.
• As provided by Article 2220 of the Civil Code, invoices, as well as all accounting records in general, are kept for a minimum period of ten years from the date of registration, in order to be presented in the event of an audit.
• For "profiled" marketing purposes, unless consent is revoked earlier, the data will be retained for 12 months from the time of provision. After the revocation of consent or the expiration of the 12-month period, the personal data will be deleted and no longer used for this purpose.
• For the purpose of using, publishing, and reproducing photographs and/or videos that feature you, the data will be retained for as long as necessary to carry out the informational and promotional activities related to the Data Controller’s operations.
• For marketing purposes, unless consent is revoked earlier, the data will be retained for 24 months from the time of provision. After the revocation of consent or the expiration of the 24-month period, the personal data will be deleted and no longer used for marketing purposes.

3.2 Notwithstanding the provisions of Article 3.1, the Data Controller may retain your personal data for the period required by specific regulations, as amended from time to time.

Art. 4 Transfer of Personal Data

4.1 The Data Controller is located in a country that provides an adequate level of security from a regulatory perspective. If your personal data is transferred to a non-EU country for which the European Commission has issued an adequacy decision, the transfer is considered secure from a regulatory standpoint. This Article 4.1 will specify, from time to time, the countries to which your personal data may be transferred and where the European Commission has issued an adequacy decision.

• The transfer of your personal data may occur to Switzerland. The transfer is covered by the European Commission's decision of January 15, 2024, which concluded that Switzerland ensures an adequate level of protection for personal data transferred from the European Union. This decision was based on the publication of the Swiss privacy law, which has been in effect since September 1, 2023.

4.2 Notwithstanding the provisions of Article 4.1, your data may also be transferred to non-EU countries for which the European Commission has not issued an adequacy decision. You are therefore encouraged to regularly review this Article 4.2 to check in which of these countries your data may be transferred.

4.3 In this article, the Data Controller specifies the countries to which it may direct its activities. This may imply the application of the regulations of the referenced country, along with those governing the relationship with the user as outlined in the Premise.
